These terms govern your use of this website. By using it, you agree to them.

1. Agreement

These Terms of Use govern your access to and use of SmartFinClub at https://www.smartfinclub.com, including all calculators, content, reports and forms. By accessing or using the site you agree to be bound by these terms and by our Privacy Policy and Financial Disclaimer, which form part of these terms. If you do not agree, do not use the site.

2. Eligibility

This site is intended for use by adults in the United States. The tax, lending and investment information published here reflects United States federal rules and is unlikely to be relevant elsewhere. If you are under 18, please do not submit personal information through any form on this site.

3. Not advice

Everything on this site is educational information and estimates. It is not financial, investment, tax, legal or accounting advice, and no advisory or fiduciary relationship is created by your use of it. The Financial Disclaimer sets this out in full and applies to your use of every part of this site.

4. Permitted use

You may use this site for your own personal, non-commercial purposes, and you may download and share reports the site generates for you. You may link to any page.

You may not:

  • Copy, republish or redistribute substantial portions of the site's content without permission
  • Scrape, crawl or harvest the site by automated means at a rate that burdens the service
  • Attempt to gain unauthorised access to any part of the site, its servers or its data
  • Interfere with the site's operation, security or availability, or introduce malicious code
  • Reverse engineer the site to create a competing service
  • Use the site or its forms for unlawful, fraudulent, abusive or deceptive purposes
  • Submit information you are not authorised to submit, or that infringes anyone's rights
  • Misrepresent the site's output as professional advice, or present it as such to others

5. Registration

Registration on this site is optional and unlocks downloadable PDF reports. It is not a financial account: no password is created, no authentication is performed, and no financial data is stored. It is a record of a name, email address and phone number, together with your consent to be contacted.

You agree that any information you provide is accurate and that you are entitled to provide it. We may decline or remove any registration at our discretion.

6. Consultation services

Where SmartFinClub offers a paid consultation, the following apply:

  • A consultation is an educational discussion. It is not regulated investment advice, tax preparation, accounting or legal services, and does not create a fiduciary or professional relationship.
  • Scope, fees and payment terms will be confirmed in writing before any consultation takes place and before any payment is taken. Submitting a request does not create a binding engagement.
  • No outcome is guaranteed. Any potential savings or benefits depend on your individual circumstances, your eligibility, applicable laws and regulations, and the strategies actually available to you.
  • Where a matter requires a licensed professional, we will say so and decline the engagement rather than proceed.
  • Any fee arrangement based on demonstrated savings will be defined in writing, including how savings are measured, over what period, what evidence is required, and what happens if savings cannot be demonstrated.

7. Documents you send us

Do not send sensitive personal or financial documents through this site unless we have specifically confirmed a secure channel for them. Where a document upload is offered, it is described together with its limitations at the point of upload. We will delete uploaded documents once they are no longer needed for the purpose you sent them.

8. Intellectual property

The content, design, code and structure of this site are owned by SmartFinClub or its licensors and are protected by copyright and other laws. Financial formulas themselves are not proprietary and we make no claim to them; the particular expression, explanation, presentation and implementation on this site are.

Reports generated by the site from your own inputs are yours to use, keep and share.

9. Availability

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, secure, or that any defect will be corrected. We may modify, suspend or discontinue any part of it at any time without notice.

10. Accuracy

We take care over the correctness of the mathematics and the currency of tax data, and we test calculations automatically. We do not warrant that the site is free of errors. If you find one, please tell us.

11. Limitation of liability

To the fullest extent permitted by applicable law, SmartFinClub, its owner and contributors shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, savings, data, goodwill or opportunity, arising from or relating to your use of this site — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.

Where liability cannot lawfully be excluded, it is limited to the greater of the amount you paid us in the twelve months preceding the claim, or one hundred United States dollars.

12. Indemnity

You agree to indemnify and hold harmless SmartFinClub, its owner and contributors from any claim, loss or expense arising from your misuse of the site, your breach of these terms, or your violation of any law or the rights of any third party.

13. Third-party services

The site loads charting and PDF libraries from third-party content delivery networks, and may in future use third-party form processing, analytics or advertising services. Those services have their own terms and privacy policies. Any such services actually in use are disclosed in our Privacy Policy.

14. Changes to these terms

We may update these terms. The current version is always published here with its date. Continuing to use the site after a change constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of the United States and of the state in which SmartFinClub is established, without regard to conflict of law principles. The site owner should confirm the specific governing law and venue with qualified counsel before publication.

16. Severability and entire agreement

If any provision of these terms is held unenforceable, the remainder continues in effect. These terms, together with the Privacy Policy and Financial Disclaimer, constitute the entire agreement between you and SmartFinClub regarding the site.
